Charged with 'common assault domestic violence related', all charges dismissed

RD was charged with one count of 'common assault domestic violence related', contrary to the Crimes Act 1900

The facts involved RD and his wife entering into a heated argument while both were highly intoxicated. Police were called to the scene and formed an impression that RD had assaulted his wife due to the fact she had called them and her behavior towards RD. 

William O'Brien represented RD, and his matter came before Manly Local Court. The presiding judge accepted representations that the police had misconstrued what had factually occurred, backed up by evidence submitted by RD's wife. 

RD had his charge dismissed, and was able to avoid a criminal record. This allowed him to continue working and return to his family as quickly as possible.
