The Queen v KM
KM was charged with 'possess a prohibited drug' (cannabis) contrary to the Drug Misuse and Trafficking Act. He had a previous criminal conviction for possessing a prohibited drug. His matter proceeded to sentence at the Waverley Local Court.
Mr Christopher Cole asked the Magistrate not to record a conviction under section 10(1) of the Crimes (Sentencing Procedure) Act 1999. The Magistrate accepted Mr Cole's representations, and declined to record a conviction, instead placing KM on a good behaviour bond for a period of six months.
This was a fantastic result for KM, considering he had a prior criminal record relating to the possession of prohibited drugs. He was able to avoid a subsequent conviction for possession.
