The Queen v MN
The facts in this matter involved MN being searched by police whilst at a hotel in North Sydney, at which point 16 capsules of MDMA were discovered. MN made admissions regarding why they had these drugs to police at the scene. As a result they were charged with 'supply a prohibited drug' contrary to the Drug Misuse and Trafficking Act.
Chris Cole acted for MN, and sent representations to the DPP so that the matter could be heard in the local court. These representations were accepted and MN entered a plea of guilty at the earliest available opportunity.
With respect to the charge of 'supply prohibited drug', MN was sentenced to a Good Behaviour bond pursuant to section 9 of the Crimes (Sentencing Procedure) Act for a period of 12 months. This was a great result for MN considering the quantity of drugs they had in their possession, intended for supply.
